Professional Negligence

Our Litigation Team are experienced in professional negligence claims as well as clinical negligence claims against a variety of Defendant Professional Practices.  We have experience of working closely with clients concerning claims against other professionals such as Accountants, Architects, Financial Advisers, Solicitors and Surveyors.  We aim to keep matters as simple and straight forward as possible and in the event that you consider that you may have a potential negligence claim against a professional practice we would urge you to make contact with our Litigation Team as soon as possible.  It is important to bear in mind that often time limitation periods apply in these sorts of cases and that investigating claims can often be easier if you begin proceedings at an early stage.  Your initial consultation with us in connection with professional negligence claims would be for a set fee and we will tell you whether or not your case is worth pursing.  If it is, we will agree with you a fee arrangement which you are comfortable with before we commence work on the investigation of the case.

Concerning claims against other solicitors we can draw in experts from our other Departments to use their professional expertise to clarify whether or not your previous firm’s duties have been carried out by them correctly.  In the event that your compensation claim has been unsuccessful it may be possible in certain cases, depending upon the limitation period, to continue your original case to avoid the expense and distress of having to pursue a separate professional negligence claim.  Alternatively you may have a claim for inadequate professional service.  Such a claim would be considered by the Legal Complaints Service who can make awards up to a limit of £15,000.  The advantage of making a claim through the Legal Complaints Service is that matters can be resolved without lengthy Court Proceedings and avoid incurring considerable costs.  For further information concerning your options in relation to negligence claims please contact our Litigation Team.
